1. Acceptance
By downloading or using the Night Vigil iOS application, you agree to these terms. If you don't agree, don't use the app. Apple's standard Licensed Application End User License Agreement also applies to your use of the app.
2. The service
Night Vigil is an investigation and entertainment tool. It displays and records genuine readings from your iPhone's sensors — magnetometer, microphone and barometer — and helps you bookmark, review and export them.
No paranormal significance is promised or implied. The app reports sensor data and flags statistical anomalies; it does not, and cannot, verify the existence or presence of paranormal phenomena. Interpretation of the data is yours alone.
3. The Investigator subscription
- Price: £4.99 per month (or the equivalent in your local currency, as shown on the App Store), after a 1-week free trial.
- What it unlocks: unlimited kept sessions and evidence export. The live instrument is free for everyone.
- Billing: charged to your Apple ID by Apple. The subscription auto-renews monthly unless cancelled at least 24 hours before the end of the current period.
- Cancelling: manage or cancel any time in your Apple ID subscription settings. Cancelling stops future renewals; you keep access until the end of the paid period.
- Refunds: handled by Apple under App Store policy.
4. Acceptable use
Record responsibly. You are responsible for complying with the laws that apply to you — including obtaining permission before recording audio of other people, and having the right to be wherever you're investigating. Don't use the app to harass anyone, trespass, or misrepresent recordings as something they aren't.
5. No warranty
The app is provided "as is", without warranty of any kind. Night Vigil is not a certified measurement instrument: readings depend on your device's consumer-grade sensors and local conditions. Do not rely on it for professional EMF surveying, or for any safety, health, electrical or structural assessment.
6. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the app, and our total liability shall not exceed the amount you paid for the app in the twelve months before the claim arose.
7. Governing law
These terms are governed by the law of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts.
8. Changes
We may update these terms; material changes will be reflected in the date at the top of this page. Continued use after changes constitutes acceptance.
